Affiliate Program Terms of Service

1. Enrollment

To enrol, you must complete the registration via our affiliate portal: https://affiliates.tests.careers/login. We reserve the right to approve or reject any Affiliate application at our sole discretion. You must be at least 18 years old (or of legal age in your jurisdiction) and have authority to enter into this Agreement.

2. Affiliate Obligations & Conduct

You agree to promote our products in a lawful, honest, and ethical manner. You may not misrepresent your relationship with us or use spamming, unsolicited emails, or other inappropriate methods. Affiliates must comply with all applicable laws.

Promotion Restrictions: Affiliates may not:

• Bid on our brand name or domain in paid search advertising.
• Promote via coupon scraping, fake discounts, or similar practices.
• Place affiliate links on sites containing illegal, offensive, or adult content.
• Send unsolicited messages containing affiliate links.

3. Tracking & Attribution

Referrals are tracked through clicks on your affiliate link. Cookie duration is 7 days. If a customer makes a purchase after this period (without clicking again), the sale will not be attributed.

4. Customer Status Definitions

Since TestsCareers sells only one-time payments (not subscriptions), statuses are defined as:

• Lead: User signed up but has not yet made a purchase.
• Trial: User has begun a free trial. Once the trial ends and payment is processed, they convert to Active.
• Active/Paid: User has completed a one-time purchase.
• Canceled: Purchase was canceled, refunded, or charged back. No further commissions are generated unless re-completed. Admins may cancel fraudulent referrals.
• Suspended: Order/payment is temporarily blocked (e.g. non-payment or fraud review). No commissions are generated. May be reactivated or moved to Canceled.

5. Commission Eligibility & Calculation

Commissions apply only to Active/Paid customers whose purchase occurs within the 7-day window. No commission is generated for Canceled or Suspended customers. Sales outside the attribution window do not generate commission.

• Tracking Disclaimer: Only tracked referrals count. We are not responsible for blocked tracking due to ad blockers, disabled cookies, network issues, or similar.
• Refunds & Chargebacks: Any refunded or reversed transactions will have commissions deducted from your balance or future payouts.
• Self-Referrals: Affiliates may not use their own link to purchase products. Such transactions are excluded.

6. Payouts

• Schedule: Monthly, paid 15 days after month-end.
• Methods: PayPal or Wise (valid account details required).
• Threshold: EURO €25 minimum (balances below roll over).
• Currency: EURO only.

7. Termination or Suspension

We may suspend or terminate participation if you breach these Terms, engage in fraud, or misuse the Program. On termination, valid unpaid commissions will be paid in the next cycle unless termination is for fraud.

Program Termination: We may discontinue the Program at any time with 30 days' notice. Valid commissions will be paid in the final payout.

8. Modifications

We reserve the right to update these Terms at any time. Affiliates will be notified of material changes. Continued participation constitutes acceptance of the new Terms.

9. Intellectual Property

Affiliates may use our branding materials only as provided, non-exclusively and revocably. Altering or misusing our materials is prohibited.

10. Confidentiality & Privacy

• Non-public information provided must be kept confidential.
• Affiliates must comply with data protection laws.
• Data Ownership: All customer data belongs exclusively to TestsCareers.
• By joining, you agree to our Privacy Policy.
• Participation is also subject to our Terms & Conditions. In case of conflict, these Affiliate Terms prevail.

11. Taxes & Contractor Status

You are an independent contractor, not an employee. You are responsible for your own taxes and expenses. The Program is non-exclusive; you may promote other companies too.

12. Limitation of Liability

We make no guarantees about traffic, sales, or income. We are not liable for indirect, incidental, or consequential damages. Liability is capped at the commissions actually paid or payable to you in the last payout cycle.

13. Indemnification

You agree to indemnify and hold us harmless from claims or damages arising from your breach of these Terms or misuse of the Program.

14. Governing Language

In the event of discrepancies between translations, the French version shall prevail.

15. Force Majeure

We are not liable for delays or failures caused by events beyond our control, including natural disasters, strikes, government actions, internet outages, or similar. Obligations are suspended during such events.

16. Link to General Terms

Participation in the Affiliate Program is also subject to our General Terms and Conditions. In case of any conflict between these General Terms and the present document, the Affiliate Program Terms shall prevail.
